1) Acceptance of these Terms

These Terms of Use apply to your access to and use of the Kids' Smart website and any related services (collectively, the “Services”). By using the Services, you agree to be bound by these Terms.

If you do not agree, you must not use the Services.

2) Eligibility and children

Kids' Smart provides educational content intended for children aged 5–16, but the Services are offered to parents and guardians who manage enrolment and communications.

By creating an account or enrolling a child, you confirm that you are a parent or legal guardian (or otherwise authorised) and that you will supervise the child’s use of the Services.

3) Accounts and security

You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.

4) Acceptable use

You agree to use the Services responsibly and in a way that supports a safe learning environment for minors. You must not:

  • Harass, bully, or threaten any child, parent, or teacher.
  • Share content that is illegal, hateful, sexually explicit, or otherwise unsuitable for minors.
  • Attempt to access accounts, systems, or data without authorisation.
  • Upload malware, scrape content, or disrupt the platform.

We may suspend or terminate access if we reasonably believe the Services are being misused.

5) Courses and educational content

Course availability, schedules, and materials may change to improve quality or respond to teacher availability. We aim to provide clear information about what a child will learn and how progress is communicated.

We may provide optional practice activities. Parents and guardians are responsible for deciding what is appropriate for their child and for supervising learning activities.

6) Intellectual property

The Services, including course materials, text, designs, and logos, are owned by Kids' Smart or licensed to us. You may not copy, distribute, modify, or create derivative works from our materials except where permitted by law or with written permission.

Children may create their own work during courses (for example, drawings or code). Unless otherwise stated, you retain rights in that original work. You grant Kids' Smart a limited licence to use that work only as needed to deliver the course and provide support to your account.

7) Disclaimers

The Services are provided on an “as is” and “as available” basis. While we work to provide high-quality educational experiences, we do not guarantee that the Services will be uninterrupted, error-free, or suitable for every learner.

Educational content is not medical, psychological, or therapeutic advice. If you have concerns about a child’s wellbeing, seek guidance from qualified professionals.

8) Limitation of liability

To the extent permitted by law, Kids' Smart will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

Nothing in these Terms limits liability for matters that cannot be limited under applicable law, including death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

9) Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. If changes are material, we may provide additional notice.

10) Governing law and contact

These Terms are governed by the laws of England and Wales. Courts in England and Wales will have jurisdiction, subject to any mandatory consumer protections that apply to you.
